  5. I do volunteer counseling at some youth centers occasionally. Here’s what I advise about public sex…don’t. With the rapid growth of security cameras(hard evidence) and sting operations, the chance of getting caught is growing. However, if you must, avoid the stalls and find a ‘unisex’ bathroom. It’s like your own private room in a public venue. It’s the potential of witnesses that make it crime. In CA, there is no law against be naked or having sex in and of itself. It’s when it can be observed by another that it becomes potentially criminal. The unisex bathroom is the ideal solution. Since the concept is relatively new, so is the construction so its not decrepit. They’re usually spacious to allow for wheelchairs and a washbasin, so there is room for 2 (or more). They’re usually in a more upscale situation and maintained throughout the day. Most importantly, they’re totally private being designed for a single person to use…you alone control access. In the stalls, others can hear, smell and glimpse through the door gap or under stall too many feet. If caught, you can be charged with a misdemeanor of lewd conduct. In CA, that is up to 6 mo. jail, up to $1,000 fine and a record. The charge you must avoid at all costs is indecent exposure. That gets you on the registered sex offender list for the rest of your life. The quality of life is over till you die. To make this charge stick, 4 elements need to be proved: 1) that you handled your genitals/butt and/or another’s to 2) gain sexual gratification in 3) a place open to the public in a way 4) that you should know that a 3rd party will/may be offended. The key element here is the potential of a witness. In the unisex bathroom, none of this can happen. Someone outside the locked door may damn well know what’s happening inside, but legally, since they can’t see, it’s mere speculation. No viable charges can be brought on speculation. The same above issues apply to car sex. It’s so easy to find a truly private space for free or little money in comparison to legal expenses. Weigh your risks and options before you play and you can still have a hot time.

  6. Since an Indecent Exposure charge can land you on the registered sex offender list, this is a powerful weapon for prosecutors and judges. In order to avoid trials and keep their dockets clear, judges will often coerce a guilty plea on a defensible lewd conduct charge by threatening to add indecent exposure charges…a living death sentence. It’s both unethical and immoral to do so, but nonetheless, common. If charged with the above, don’t try to defend yourself, get council.
