  9. The Japanese have censored porn for at least the last 1,500 years. A producer client had me produce a research paper on the subject before he ventured into projects in Japan. He knew I was fond of Japan and spoke the language. If we start with the Tokugawa Bakufu(Shogunate 1600-1868), we see the rise of a merchant class that can afford woodblock prints. We see the popular rise ohunga'( porn prints) and Ukiyo-e (Floating World prints 1750-1868) with their images of beauties, geisha, prostitutes, etc. These couldn’t be published without the aratame/kiwame (censor seals). Then, as now, this is self imposed censorship using law as a guideline. With the demise of the Shogunate and the Meiji Restoration ( 1868-1912) the old Samurai class was outlawed, but they simply reappeared as the new politicians. The same we saw happen in Russia. They quickly wanted to restore their old power and control the new Western influences. They wrote a series of laws…the Suppan Jorei (publication ord. 1869) which outlawed many foreign concepts and suppressed many new domestic ideas including all porn; the Shimbunshi Jorei ( press ord. 1875) which allowed the government to close any press for the public good; Shuppan Ho (publication law 1893) which revised and expanded these powers and would remain unchanged until 1949. Though they appeared liberal and progressive to the world, they had quietly recreated an absolute powerbase behind the scenes.

    Ironically, during this repressive time they made sodomy legal in 1880 making them way ahead of the Western world.

    As the Taisho(1912-1924) and early Showa(1926-1945) periods progressed Japan became more economically and militarily powerful. They kept tightening their central grip on info. They added the death penalty to the censor laws in 1928. By 1940 they upgraded the Johobu ( information and propaganda dept.) to the Joho Kyoku ( info dept.) of the Home Ministry. In 1941, they issued the Kokka Sopoin Ho( nat’l. mobilization law) that banned all free speech, press, everything without prior government approval. With the surrender and the U.S. writing the new Constitution, Art.21 gave the Japanese people freedom of speech guaranteed by law for the first time in their history.

    Porn in the postwar period was governed by the existing 6 Codes of Law from the turn of the century that formed the basis of all Japanese law. The Occupation Govt. just adjusted them to conform to the Constitution. The criminal/penal code of 1907, Art.175, calls for the ban of all ‘indecent’ material. They, like us, have been litigating just what is obscene ever since.

    The censorship you see today is self imposed by the professional organizations that govern each media outlet. They do this to keep the government from directly imposing themselves in their business. They use the code, evolving case law, changing public opinion and pushing the envelope to effect change. In the 1990s, pubic regions and even pubic hair were obscene. The more conservative groups block everything, while the more liberal just use thin bars. The government basically has a hands off attitude unless something is egregious and seldom prosecutes.

    In 2004, Suwa Yuuji was found guilty for his hentai manga “Misshitsu” fined and avoided jail time for pleading guilty. He appealed to the Supreme Court on the grounds that the net was way more obscene and censorship violated his free speech under the Constitution. He lost and they tripled his fine. This had a chilling effect and many bookstores/chains dropped porn or created an ‘adult section’. This is when the influential magazine, Barazoku(1971-2004)ceased publishing. It was the first widely distributed gay magazine and instrumental in popularizing Yaoi, Bara, etc. Yet this same Court ruled in 2003 that Mapplethorpe’s most explicit pictures could be shown as is. In 2005, the film “Kinsey” with it’s graphic penises/vaginas was allowed to be shown to the public uncensored. This was the first time the public saw such things without pixels. But as more conservative governments have risen, censorship is swinging back. In 2007, police started arresting webmasters for not use bars. This has lead to urabon, underground porn, and doujinshi, self publishing, to avoid the publishing house censors. These are often sold/traded at Comiket( like Comicon) or just downloads from the net that the government can’t readily control. So the censor game continues…

Its too bad that they are having a wave of new conservatism over in Japan with those forces trying to quash this work–I do find it very erotic and very sexual—I can get off as easily looking at this sort of sexy Hentai–as I can looking at actual photos and video–perhaps even more so—I often place myself as one of those characters depicted in the work—if only real life could be a fraction as cool as some of that stuff is!! LOL

    I love the ultra macho stuff/ It’s a shame the artists aren’t credited here but the publishing of any copyright image on line is a risky business.
